Who we are

The Momenvi site at momenvi.co.il is operated by סטפטק, an osek patur (a sole trader under Israeli tax law) no. 319038782, of ת.ד. 77512, אשדוד (“Momenvi”, “we”).

Use of the site and the purchase of a product through it are subject to these terms. Nothing in these terms detracts from rights given to a consumer by law that cannot be contracted out of.

What the service is

You answer a questionnaire and build, yourself, on our templates, a personal interactive experience in Hebrew that opens from a link. The link is delivered to you, and you pass it on to whoever you choose.

The link is not meant to be published in search engines. It does, however, work as an access link: anyone holding it may be able to open the moment, so pass it on only to people you want to be able to see the content.

The plans

In every plan: one experience that you build and edit yourself right up to the moment you send it, automated content checks before publishing, and a private link that does not appear in search engines. What changes between the plans is set out here.

The prices shown are the final prices to the consumer. The business is an osek patur — exempt from VAT — so no VAT is added separately. There are no additional costs. The plan is chosen before payment, and what was bought is recorded on the order.

There is no subscription, no automatic renewal and no recurring charge.

Building, payment and publishing

The link is delivered immediately when the payment is approved. There is no queue, no wait and no business days — publishing is automatic, and the content checks run before the payment, so by the time it is approved the moment is already ready to publish.

If for a technical reason on our side the link is not delivered, and we have not managed to fix it within one business day — you get a full refund.

Payment

Payment is made on a secure PayPlus page. Card details are entered there and are never held by us at any stage.

After the payment is received you will be given an appropriate accounting document, as the law requires.

Your account

When the purchase is completed, a personal account is opened on the email address you gave, linking your moments and purchases to it. The account stays locked until you verify the email address and choose a password.

An account that has not been verified within 90 days is deleted. Deleting it does not delete the accounting record of the transaction, and does not automatically cancel a live moment that has already been delivered.

Your content

The content you wrote and the photographs you uploaded stay yours. You give us permission to use them solely in order to build the moment, to show it to whoever opens the link, and to support you — and for no other purpose.

• that the content and the photographs you uploaded are yours, or that you have permission to use them.
• that the person receiving the surprise is someone you are in touch with, and that there is nothing preventing you from approaching them.
• that the content is not harassing, threatening or abusive, and is not intended to present anyone in a false light.

Please do not enter sensitive information the moment does not need.

We may refuse an order or take down a live link if the content crosses those lines. If we do, you get a full refund — unless the moment was aimed at harassment.

The recipient, and their replies

We do not ask the recipient for a name, an email address or a phone number, and we never contact them in any way. If they choose to answer inside the moment, the answer is kept and shown to you. The full details are in the privacy policy.

Map services

If you filled in a meeting place, the moment shows a link to an external map service. Following it takes you off our site and onto that service, which runs under its own terms and privacy policy.

Automated processing

The content you wrote goes through automated software checks before publishing — confirming that the Hebrew is sound and that nothing is missing — and is not read by a person as part of the service.

As at the date these terms were updated, user content on the live site is not passed to any external generative artificial-intelligence service.

Fixes after publishing

After publishing you can edit the moment from your account, within the number of editing rounds included in the plan you bought. Every round goes through the same automated content checks, and goes live on the same link with the same expiry. If the rounds have run out, or something is stuck — write to us.

Cancellations, defects and refunds

• Before you pay — There is nothing to cancel. You build for free and pay only when you send, so we never hold money for a moment that has not been delivered.
• We missed the time we committed to — A full refund.
• The result is not what you asked for — We fix it. If it is still not what you wanted after the fix, we refund you.

A moment is built from your own words and your own photographs, and it is handed over at the instant it is bought — the link goes live when the payment is approved. It is personal work made for you and delivered immediately, and so the fourteen-day right of cancellation that the Consumer Protection Law gives in a distance-selling transaction does not apply to it. The rules above are what we commit to in any case, and they are more generous than the law requires.

Intellectual property

The content you wrote stays yours. The system, the designs and the themes stay ours. You are free to share the link.

Privacy and keeping information

What is collected, who reaches it, which providers are involved and how long it is kept — all of it is set out in the privacy policy, which is an integral part of these terms.
